Friend, i have a client in jail right now for violating probation. Dude is a complete moron and its a shame because he has a kid, but hes in jail now based on the VP. So at least down here, probation is strict. Weekly appointments, weekly follow ups for rehab, therapy, whatever it is.

First, there is no inference that someone selling drugs has any propensity for violence, so him being released with supervision does not strike me as irresponsible honestly, if it is of course a minor first time offense. If he is repeat that is different, and if it selling to kids, large quantity, etc it is also different. But selling a dime bag to your buddy doesnt warrant incarceration to me. Selling to kids, selling harder drugs, then yes. Each case is specific and unique.

I will say i have spoken with some criminal attorneys who have gotten violent offenders off and it does bother them at times. I could never do it personally, but everyone is entitled to representation, and if the prosecutor fails to prove their case, then it is what it is.

By the way, part of any plea deal is probation, which is supervision, this includes arrests for possession.

Sentencing is part of the law. It is written directly into the penal code...misdemeanor, $1000 fine to 1 year in jail, etc. That is in the actual LAW, and there is discretion written into it. Just stop, leave the law to the lawyers.

I guess you have reading comprehension problems, dont represent drug dealers. And yes, all of my clients have jobs, and missing work for court appearances is hard on them. We only represent clients with money to pay us, and they all must show they have a steady job.

This just shows that you dont have any understanding of the law. The laws regarding sentencing are not black and white.
Here is why. The prosecutor has the ability to agree to let the defendant plea down to a lesser offense, i.e. a different law than applied to the initial crime, and accordingly, a different penalty.
The judge then has the discretion as to approve or not approve the plea deal, and can on his or her own, increase or decrease the sentence. There is a lot of leeway from both the prosecutors and the judge on every case. not black and white at all.

i am part of the problem? You have no clue what you are talking about. The constitution affords every defendant the right to a fair trial and to representation by an attorney, i am part of the solution, not the problem. I also know what i am talking about, as i negotiate plea deals with judges and prosecutors all the time. I dont represent drug dealers, but i do represent those who have DUIS, drug arrests, and sometimes lesser violent crimes (all of my clients have served jail time for these). With the drug arrests, the judges really push rehabilitation, but around here, they are very strict with DUIs, and violent crimes forget it.

you are all criminal attorneys LMAO. Im literally before these so called liberal judges every week, i can assure you, most judges are very tough.

Well i am, and practice alot of criminal law, not major offenses like murder or rape or anything, but minor offenses including some felonies.
I have been before many really tough judges who refused to grant my clients any leeway or slack, so there is definitely not a proliferation of liberal criminal judges. There are some judges who are more lenient than others for sure though, but ive never seen a judge be irresponsible.
One point @Ginx snewx doesnt understand is that there are limited resources in the judicial system. Half the time there arent enough court officers in the criminal courts due to funding issues, and our jails are over crowded. Also, putting guys in jail for years for minor violations destroys society, as many of these people are fathers, husbands, and hard working employees who make a mistake. Start putting everyone in jail and you will crush the taxpayer, families, and the economy.
Again, unless you have been in the criminal court system representing either the government or defendants, you have no idea what you are talking about.

At 10:00 am on July 10, Central Park is the coolest ASOS site in the NYC Metro at 81 degrees. Even Westhampton is warmer at 82. Clear issue of horrible siting.

Not really. It’s just an article complaining that official weather obs are taken anywhere in an urban area other than under a tree (like Central Park). According to that article unless a reading for a city is taken outside of a built up area it’s not a valid reading. Notwithstanding the fact that millions of people live in said urban center in the built up area and might want to know hot it is where they live, which is not under a tree.
and not to mention that website is purely dedicated to denying climate change. Gotta check the source.

Lithium gets old, repeats same songs. 94.3 the SHARK is pretty good out here, and 90.7 WFUV is a city station which is good for alternative music. I only like the Adam Sandler Hannukah song.
Seeing Dark Star Orchestra at the Paramount in Huntington Sat night, love that venue.
